2. DEFINITIONS
MINISTRY: the Turkish Ministry of Trade. LAW: Consumer Protection Law No. 6502. REGULATION: the Distance Contracts Regulation. SELLER: the natural or legal person offering goods to consumers in the course of commercial activity. BUYER: the natural or legal person acquiring goods for non-commercial purposes. SITE: the Seller's website. GOODS: movable items and intangible goods prepared for use in electronic form (such as software).
3. SUBJECT AND PRICES
This agreement regulates the rights and obligations of the parties regarding the sale and delivery of the goods ordered by the BUYER on the SELLER's website, under the Law and the Regulation. The sale prices listed on the site include VAT and are valid until updated or changed; prices announced for a limited period are valid until the end of that period. Product prices are Euro-based; the lira amount is calculated from the Central Bank of the Republic of Türkiye Euro selling rate plus the operator's margin, and the lira total shown at the payment step when the order is placed is binding.
4. GENERAL PROVISIONS
- Information and acceptance. The BUYER confirms having read the basic features, sale price, payment method and delivery information of the goods on the site and having given electronic confirmation.
- Delivery. Each item is delivered within the 30-day legal limit, within the time stated on the Delivery & Returns page, to the address given. If the goods are not delivered within this period, the BUYER may terminate the agreement.
- Shipping fee. Shipping is paid by the BUYER unless free shipping applies; the fee is shown before payment.
- Inspection. The BUYER must inspect the goods before accepting them from the carrier and must not accept damaged or defective packages; a damage report should be made with the carrier and the SELLER informed. Goods accepted are presumed undamaged.
- Impossibility of sale. If the SELLER cannot supply the goods, the BUYER is notified in writing within 3 days and the total price is refunded within 14 days.
- Force majeure. If delivery cannot be made in time because of events beyond the SELLER's control, the BUYER is informed and may cancel the order, request replacement with a similar product, or defer delivery. Card refunds are made within 14 days; the bank may take 2–3 weeks to reflect it.
- Unauthorised card use. If the payment card is found to have been used without authority after delivery and the price is not paid to the SELLER by the bank, the BUYER shall return the goods within 3 days at the SELLER's expense.
5. RIGHT OF WITHDRAWAL
The BUYER may withdraw from the contract without giving any reason within 14 days of receiving the goods (or the person/institution at the address given), by notifying the SELLER:
Seller: Barış Şimşek
Address: Kirazpınar Mah. Kirazpınar Evleri 5800 Ada Küme Evler No:1 E3 İç Kapı No:2 Gebze/Kocaeli
E-mail: info@ecuhardmotochip.com · Phone: +90 538 372 73 30
- Notice must be in writing (registered mail or e-mail) within the 14 days and the goods must be unused and in their original packaging with all accessories, together with the invoice (for invoices issued to companies, a return invoice issued by the company is required).
- The SELLER refunds the total price and any documents binding the BUYER within 14 days of receiving the notice, using the same payment method. The goods must be returned within 10 days of the notice. If the value of the goods has decreased through the BUYER's fault, the BUYER compensates the SELLER in proportion to that fault; changes arising from proper inspection during the withdrawal period are not the BUYER's responsibility.
- Return shipping: on withdrawal, the cost of returning the goods is borne by the BUYER. Please use a traceable carrier and keep your receipt; a withdrawal form template is on the Delivery & Returns page.
- Defective goods: the BUYER's statutory rights for defective goods (repair, replacement, price reduction or termination within the legal periods) remain reserved; in that case the return cost is borne by the SELLER.
6. GOODS NOT SUBJECT TO WITHDRAWAL
The right of withdrawal cannot be used for goods prepared to the BUYER's specifications or clearly personalised; goods that cannot be returned for hygiene or health reasons once their packaging has been opened; goods that after delivery are mixed with other items and cannot be separated; digital content and intangible goods delivered instantly in electronic form; software, data media and similar goods whose packaging has been opened; and the other cases listed in the Regulation. To be returnable, goods must be unused, untried and in intact packaging.
7. DEFAULT
If the BUYER pays by credit card and defaults, the BUYER accepts that interest will be payable under the card agreement with the issuing bank and that the bank may take legal action; the BUYER also compensates the SELLER for losses caused by late performance.
8. COMPETENT AUTHORITIES
For disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the BUYER's or the SELLER's place of residence are competent, within the monetary limits announced each year by the Ministry of Trade.
9. EFFECT
